Junio 28 de 2019.- El Tribunal Estatal Electoral de Michoacán, determino proteger los derechos políticos del síndico municipal al resolver que puede, contrario a lo que “le había ordenado” el cabildo, participar en la firma de convenios jurídicos en toda suerte de litigios en el que el gobierno municipal sea parte, pues es facultad que solo le compete a él.
Mediante acuerdo, este viernes el TEEM dio la razón jurídica al síndico Miguel Ángel Peraldí Sotelo, respecto a que el cabildo pretendió acotar sus facultades al acordar que “debe abstenerse” de participar y firmar acuerdos y convenios, ello luego de que por mayoría buscarán retírale las facultades que el consagra la ley orgánica municipal, y buscar que abdicara su responsabilidad jurídica en favor de la alcaldesa y de abogados que ella señalaba para tenr la representación legal
Si bien el cabildo acordó por mayoría ambos puntos, el funcionario acudió al TEEM para que protegiera sus derechos políticos para los que fue electo como síndico, ya que la ley le consagra a él, de manera única, la representación jurídica del municipio y no a la alcaldesa, quien busco acotárselos.
Es de destacar que el propio TEEM se declaró incompetente para resolver si debe o no otorgar poderes jurídicos a otros abogados que le sean propuestos, o solo a quien él mismo determine para el apoyo de las funciones.
